
IPaD assisted developer group Elan Homes with a S73 application to amend the details and requirements for off-site highways junction improvements as appended to an earlier outline planning application for their site.
The requirement for IPaD’s input came about once it was made clear at the delivery stage of the development that the initially proposed and accepted highways work flagged up unforeseen constraints to their delivery and that in engagement with IPaD, advice was recommended to the client that indicated better alternative schemes could be delivered that offered reduced level of constraint and which could be considered acceptable in highways design terms.
IPaD supported this process by undertaking new detailed design drawings and supporting information to support the justification for the change in schemes being proposed.
The S73 application was met with resistance from the Local Parish Council local resident groups and despite a positive recommendation by the highway’s authority, the application was rejected at planning committee and subsequently went to appeal.
To support the appeal process IPaD was the named expert witness group and was charged with the production of a written statement of case and written rebuttals to the listed objections as raised by the planning authority.
IPaD successfully rebutted all counter objections, and the appeal was subsequently upheld by the Planning Inspector. The scheme has now moved towards the full delivery stage and IPaD continues our role as principal designer and is working alongside the highways authority in bringing forward a S276 agreement for delivery of the highways works.
